This protocol governs how all incoming concerns, disputes, and harm reports are received, classified, and resolved. --- ## Triage Classification All contacts received at flame@rodrik.io are classified within 4 hours of receipt into one of three tiers: ### Tier 1 — Urgent Harm Report **Definition:** A user reports that a FLAME-certified system is actively causing harm to real people in a live production environment. **Response window:** 4 hours from receipt. **Action:** Dr. Rodriguez or Wilmer Toro reviews immediately. If harm is confirmed, the system in question is flagged in the FLAME record and the user is advised to suspend the certified system pending review. A written incident summary is published to the self-audit log within 72 hours. ### Tier 2 — Technical Failure Report **Definition:** A user reports that the FLAME tool itself malfunctioned. **Response window:** 24 hours from receipt. **Action:** Dr. Rodriguez reviews and determines whether a deployment fix is required. ### Tier 3 — Score Dispute **Definition:** A user disagrees with their certification score or believes a specific dimension was assessed incorrectly. **Response window:** 48 hours from receipt, per Terms of Service commitment. **Action:** Dr. Rodriguez reviews the specific dimension and answer and responds with explanation. --- ## Appeals Process ### Primary Appeal A user who believes their FLAME score is inaccurate or biased emails flame@rodrik.io describing the specific dimension and the answer they believe was misscored. Dr. Rodriguez reviews personally within 48 hours and provides a written explanation of the scoring decision. ### Secondary Appeal — Christian Calix Review A user who disagrees with Dr. Rodriguez's appeal decision may escalate to Christian Calix, Independent Consultant, within **7 days** of receiving the initial response. To escalate: 1. Email flame@rodrik.io with the subject line "Secondary Appeal Request" 2. Include the original dimension, answer, score, and Dr. Rodriguez's initial response 3. Christian Calix will review the dimension in question and provide a written recommendation within **14 days** 4. Christian Calix's recommendation is final and binding on Rodrik Publishing Christian Calix's review scope covers whether the rubric was applied accurately to what was reported. It does not cover whether the rubric itself is equitable across cultural contexts — that is addressed through the external methodology review process. --- ## Authority Structure ### Dr. Oscar A. Rodriguez — CEO Full authority over all system operations including: - Modifying scoring algorithms, harm detection parameters, and conversation engine - Updating Terms of Service, Privacy Policy, and all governance documents - Deploying code changes via GitHub - Issuing or revoking certifications - Shutting down the system ### Wilmer Toro — EVP **Emergency authority** activates when Dr. Rodriguez is unreachable for more than **2 hours** during a Tier 1 incident: - Take the FLAME system offline via Vercel dashboard - Issue a public notice of temporary suspension via droscarrodriguez.com - Respond to the reporting user acknowledging receipt and suspension - Deploy code changes to the GitHub repository **if both Dr. Rodriguez and Wilmer Toro are in agreement** prior to or during the incident Wilmer Toro does not have unilateral authority to modify the scoring algorithm, update the Terms of Service, or issue certification outcomes without Dr. Rodriguez's agreement. ### Christian Calix — Independent Consultant Two roles: **Tiebreaker:** In the event of a disagreement between Dr. Rodriguez and Wilmer Toro on any governance decision — including whether to suspend the system, how to respond to a Tier 1 incident, or whether a code change is appropriate — Christian Calix serves as an independent tiebreaker. His recommendation resolves the disagreement. **Secondary Appeals Reviewer:** Users who disagree with Dr. Rodriguez's appeal decision may escalate to Christian Calix per the Appeals Process above. His written recommendation is final and binding. Christian Calix has no unilateral operational authority over the system. --- ## Governance Document Amendment Process Changes to this Triage Protocol require: 1. Review against the existing incident classification framework 2. Documentation of the reason for the change 3. Commit to GitHub with a descriptive commit message 4.
